MTS City Breaks - Terms and conditions

GENERAL CONDITIONS
1. By booking, registering for, making a payment towards, or participating in a tour or other travel product or service with MTS City Breaks, you agree to MTS City Breaks’ following Terms and Conditions.

2. The client accepts that MTS City Breaks documents in the form of faxes, e-mails, vouchers and invoices form the basis of our contract for the reservation. It is imperative that you check them to avoid any misunderstanding. Client must advise MTS City Breaks if written confirmation has not been received.
3. Trade fairs, Conventions and Festivals - When availability is limited due to trade fairs, conventions and festivals, our normal rates are not applicable and higher rates will apply.
4. Such periods are shown for each city, but hotel availability may be affected also by in-house conferences. However, in other areas, confirmation may take more time and rates may be higher than rack rates
Payment - For reservations is due by the date shown on our invoice and always prior to the customer’s arrival in the first city. Regardless of whether vouchers have been issued or not, we reserve the right to cancel any bookings made if payment has not been received, or if payment is still outstanding for any previous unrelated reservations. The client will have to pay any cancellation costs that arise as a result of these cancellations.
5.If the traveler wishes to alter his/ her stay directly with the hotel, MTS City Breaks should be contacted immediately in order not to be charged rack rate6. MTS City Breaks reserves the right to amend prices due to currency fluctuations or Governmental action. However, once a booking has been confirmed, the price is guaranteed regardless of any currency fluctuations.
7. In the very unlikely event that the confirmed hotel cannot provide the booked accommodation, the client accepts that it is the hotel’s responsibility to find an alternative hotel of at least similar standard and provide transportation as appropriate to this alternative hotel. MTS City Breaks makes every precaution to ensure hotels are professionally managed so that any such occurrence is exceptionally rare. MTS City Breaks shall have no liability in respect of any other costs, losses or damages existing out of or in connection with a relocation of accommodation since such relocation is outside the control of MTS City Breaks.
8. MTS City Breaks is not responsible for any accident, loss, detention, annoyance, delay and expense due to quarantine, strikes, any other event of force majeure, failure of any other means of conveyance, to arrive and depart as scheduled, disturbances, government restrictions or regulations, discontinuance or change in transit or hotel services and other causes over which MTS City Breaks has no control.
9. Baggage and all personal belongings are at the owner’s risk.
10. Our rates are strictly private and confidential for use only by the Tour Operator or agency to which they were delivered and should not be disclosed unmarked-up to any person or organization outside the tour operator or agency. These rates can only be sold packaged to other tour operators and travel agents, unless otherwise agreed.
11. Our rates apply for the leisure market only.


RESERVATION PROCEDURES
Reservations can be made by e-mail, or on our web site at www.mtscitybreaks.eu
Only when the booking status is showing “voucher issued” the booking is finalized.
All rates are net
, non-commissionable, per room, per night and inclusive of all applicable local taxes. Additional city taxes may apply during check out and only the client will bear such costs.
All dates are in format dd/mm/yy.

NON-CONTRACTED HOTEL RESERVATIONS
MTS City Breaks will be pleased to handle any reservations for hotels not listed in this site.
Rates for hotels not listed in our tariff (non-contracted Hotels) may exceed prevailing rack rates due to service charges levied to cover expenses incurred. We are unable to process any refund requests for cases where the rate exceed the rack rate or where client cancelled directly.

PRICES
All prices are in Euro
Fair or Exhibition and Special Events prices could be higher than the rack rates.
All rates are per night and include VAT and hotel service charges.
For groups we can offer you competitive prices.

VALIDITY OF PRICES
All prices are subject to change without previous notice due to changes in hotel tariffs, government taxes, etc.

BLACK-OUT PERIODS
During Fairs/Exhibitions and special events, the prices published in our system may not apply and could be higher than the rack rates. We will notify you at the time of booking.

PAYMENT PROCEDURES
All reservations are subject to pre-payment in full prior to the client's arrival date unless other credit terms have been established and approved by MTS City Breaks in advance.
For bookings regarding groups payment conditions will be informed.
For bookings during Special Events pre-payment of the total amount is required.

LATE CHECK
-OUT
Hotels reserve the right to impose a service charge for late check out. All charges will be paid on the spot.

REFUNDS
Any claims for refunds must be submitted to MTS City Breaks in writing within 15 days of completion of travel. Documented evidence to sustain a claim must be forwarded to MTS City Breaks along with your refund request.
MTS City Breaks will not accept any refund request if a client cancelled a hotel/service directly and failed to obtain the following information:
(1) Voucher duly marked
(2) Check out bill

VOUCHERS

Issuance of a voucher means acceptance of all terms and conditions mentioned hereof.

COMPLAINTS
Any complaint about the booking service must be notified to MTS City Breaks in writing or by email as soon as possible. Any complaint regarding the travel arrangements must be brought to the attention of the local supplier’s as early as possible during the stay of the passenger and a copy should be given to MTS City Breaks.

RESPONSIBILITY AND LIABILITY

MTS City Breaks is not responsible, nor liable, for any damage, loss or injury caused to any passenger by any of MTS City Breaks suppliers. If MTS City Breaks is not able to furnish the services for any reason being under its control – due to its fault (including due to overbooking by it), MTS City Breaks shall promptly inform the client. In this case, it will be the express responsibility of MTS City Breaks to first provide either the same or higher product/service failing which it will have to make alternative arrangements of equal or superior quality at its expense which should be acceptable to the client; otherwise, MTS City Breaks shall have to initiate a refund to the client for such failure. Any additional costs caused by MTS City Break’s fault related to transfers between hotels will be at MTS City Break’s own expense. Any hotel change caused by MTS City Break’s fault shall be authorized by the client. Further in such scenario, MTS City Break will also provide free private transportation to the alternative upgraded accommodation and reimburse and compensate the client for all reasonable costs and expenses made, suffered, paid or incurred due to MTS City Break’s fault.
MTS City Breaks does not operate, nor own or control any means of transportation. Therefore, MTS City Breaks cannot assume any liability in case of injury, loss, damage, delay or accident.

MODIFICATIONS OF THESE TERMS AND CONDITIONS
MTS City Breaks reserves the right to modify these Terms and Conditions at any time without any prior notice. Users are responsible for regularly reviewing these terms and conditions.
Continued use of this Web site following any such changes shall constitute the user’s acceptance of such changes.

CONFIDENTIALITY
The information contained within this Internet site, regarding tariff and other matter concerning the business practices and pricing policies of MTS City Breaks, is confidential and extended to clients only.

INFORMATION AND PRIVACY

When engaging with our travel products and services, including making a booking or interacting with MTS City Breaks’ website, you entrust us with certain personal information. Please refer to our detailed Privacy Notice on our website for a comprehensive understanding of our practices.

By utilizing our website, booking travel though it, or providing any personal information, you explicitly indicate your acceptance of our Privacy Notice.

CANCELLATION CONDITIONS
Cancellation deadline is indicated next to each service price, unless otherwise specified on our booking confirmation.
Reservations will be automatically cancelled by the time limit date and time, unless voucher has been issued.

OUT OF SPECIAL EVENT PERIOD
Any confirmed-booking cancellations that are received after the above mentioned deadlines will result in one overnight cancellation fee plus one way transfer (if any) and the value of any services arranged for the first day of the clients stay.
In case of early
check out or Non-Show, the total cost of the nights /services booked will be invoiced, unless the Hotelier / Supplier has accepted and signed differently. Refunds are ONLY possible upon presentation of this Hoteliers / Suppliers confirmation.

CANCELLATIONS FOR GREEK HOTELS
G.N.T.O. (E.O.T.) permits hotels to charge up to 100% of the whole stay reserved for any accommodation nights not used no matter the reasons or circumstances.

You are kindly requested to inform your clients before issuing the Voucher. We remind you that any refund is possible only through written approval and authorization of the Hotelier and according to the terms hereof.

CREDIT CARDS
The majority of the hotels, internationally, have established a policy to request the clients’ credit cards as a guarantee for the payment of their EXTRAS. You are kindly requested to inform your clients that they should be very careful and check the bills before signing them and not to accept, under any circumstances, charges for prepaid services described on their vouchers.

 

ACCESS CODES AND CREDENTIALS

A confidential and personal access code will be set up for the clients and will be reserved unique and exclusively for each of them. No access code can be transferred or disclosed to any third parties. The client will take all necessary steps to maintain strict confidentiality of this code. Any unauthorized use of the access code by any third party due to the client’s negligence or security system’s failure, makes the client liable for any damage caused due to these. If the client believes the code has lost its essential confidentiality, a new access code shall be immediately requested to MTS City Breaks. It is the client’s solely responsibility to immediately inform MTS City Breaks if a member of staff with access to the platform is no longer employed by the client. After entering the platform for the first time, the client and its users must change the password initially assigned to keep absolute confidentiality. MTS City Breaks reserves the right to change the client’s access codes for security reasons. In this case the client will be informed with sufficient time in advance to avoid any inconveniences.


CLAIMS
Any problems that may occur during the passenger’s stay must be reported immediately to MTS City Breaks, in order for us to try our best and fix, where possible, the problem.
All claims must be reported during the passenger’s stay to the person in charge, in writing and in every possible detail, a copy of which should be given to MTS City Breaks the soonest. All claims will be carefully examined and answered within a reasonable period of time.

 

WEBSITE USE DISCLAIMER AND CLIENT LIABILITY LIMITATIONS

MTS City Breaks acting as the tour agent provides an online platform for bookings, which by its nature is not error free. Accordingly, it does not warrant that the use of the platform’s products and services will be uninterrupted, continuous, or error free. The client understands and acknowledges that there may be downtime, network congestion, outages, scheduled maintenance, or such other events beyond the reasonable control of MTS City Breaks and therefore it shall not be responsible for the same. Further, MTS City Breaks has deployed the requisite controls for security and authentication checks. If there is any compromise due to no direct and sole error or omission of such client, including compromise in the log-in credentials of the client, then the client cannot be held responsible for such compromise.
 

OBVIOUS ERRORS AND MISTAKES

Obvious errors and mistakes (including misprints, typographical errors, and errors in calculating currency conversion, errors in pricing in general, etc.) are not binding. Notwithstanding the above, MTS City Breaks or its supplier(s) reserve the right to cancel the booking and in the event of such cancellation, without incurring any liability to the client, MTS City Breaks or its supplier(s), as the case may be, will refund the client in relation to such booking(s) (if applicable).
